Litigation
This is a traditional path for divorce. Litigating your case means going to court and entrusting the judge to make fair decisions. This is an appropriate option when you and your spouse can’t reach an agreement about major issues like child custody and property division. It may also be the best option in cases involving domestic abuse.

Mediation
When you choose to resolve your divorce through mediation, you and your spouse will retain a neutral third-party professional to help facilitate agreements on the terms of the divorce. Mediation provides more privacy than litigation and allows you more control over the decisions that are made.

Collaborative Divorce
Like mediation, collaborative divorce is private and hands-on. However, you and your spouse will work with a larger team to reach an agreement. In addition to a mediator, you may work with a financial advisor, a mental health professional, an accountant, an asset appraiser, and others.

Negotiated Settlement
The Negotiated Settlement is an agreement reached by the parties outside of court but not necessarily through the mediation process. In San Diego County the court requires a mandatory settlement conference as a mandatory step before your divorce case goes to trial. If a negotiated settlement is reached, the parties will avoid the emotional and financial ordeal of going to court. The negotiations remain confidential and allow for a little more flexibility.
