SMS Messaging Terms & Conditions
These SMS Messaging Terms & Conditions (“SMS Terms”) govern text messages sent by or on behalf of Cage & Miles LLP (“Cage & Miles,” “we,” “us,” or “our”) to clients, prospective clients, and other individuals who have agreed to receive text messages from us.
These SMS Terms apply only to our SMS messaging program and supplement our Privacy Policy and any other agreements that may apply to your relationship with Cage & Miles.
1. Types of Messages
By providing your mobile phone number and opting in to receive text messages from Cage & Miles, you will receive reoccurring informational and service-related messages concerning:
- Consultation requests, scheduling, confirmations and reminders;
- Intake and client onboarding communications;
- Updates an administrative communications concerning your inquiry or legal matter;
- Requests for documents or information;
- Firm, account, and service-related notifications;
- Billing and payment-related communications; and
- Other communications relating to services you requested or your relationship with Cage & Miles.
This SMS program is intended for informational and service-related communications. Cage & Miles will not use your consent to this program to send marketing or promotional text messages unless we separately disclose that purpose and obtain any consent required by applicable law.
2. Consent to Receive Messages
You may opt in through our website, intake forms, client agreements, consultation, written or electronic communications, or other approved methods made available by Cage & Miles.
By providing your mobile telephone number and opting in, you:
- Authorize Cage & Miles and its service providers to send recurring text messages to the number you provide;
- Confirm that you are the subscriber or customary user of that telephone number and are authorized to provide consent for messages to be sent to it; and
- Understand that messages may be sent using an automated messaging platform or other automated technology.
Your consent to receive text messages is not a condition of purchasing any services or retaining Cage & Miles for legal representation.
Consent applies only to the telephone number you provide and to the categories of messages disclosed when you opt in.
You may revoke your consent at any time as described in Section 5 below.
3. Message Frequency
Message frequency varies depending on your inquiry, consultation, intake process, legal matter/status thereof, account activity, relationship with the firm, and your communication preferences.
Cage & Miles does not guarantee a particular number or frequency of messages.
4. Message and Data Rates
Message and data rates may apply according to your wireless carrier and service plan. Cage & Miles LLP is not responsible for charges imposed by your wireless carrier.
5. Opting Out and Revoking Consent
You may opt out of SMS communications at any time by replying STOP to any SMS message received from Cage & Miles.
After opting out, you will receive a final message confirming your removal from future SMS communications. No additional messages will be sent unless you subsequently opt in again.
Opting out of text messages will not prevent Cage & Miles from contacting you through other lawful methods, such as telephone, email, secure client portal, or postal mail. Opting out will not otherwise affect an existing attorney-client relationship or your obligation to respond to communications concerning your legal matter.

If the messaging technology used for a particular message does not permit replies, the message will provide another method for obtaining help and revoking consent.
7. Telephone Number Changes and Reassignment
You agree to provide Cage & Miles with a valid mobile telephone number that you are authorized to use.
If you stop using, cancel, transfer, or reassign the telephone number you provided to us, you agree to promptly notify Cage & Miles so that we can update our records and avoid sending messages intended for you to another person.
If Cage & Miles is informed or reasonably determines that a telephone number has been reassigned or does not belong to the intended recipient, we may stop sending messages to that number.
8. Privacy
We value your privacy and are committed to protecting your personal information and handle your personal information in accordance with our Privacy Policy.
No mobile telephone information, SMS opt-in data, or consent records will be sold or shared with third parties or affiliates for their own marketing or promotional purposes.
We may disclose your personal information (such as your name and mobile number) to service providers that assist us in delivering, administering, securing, or supporting our SMS communications; when directed or authorized by you; in connection with the administration of your inquiry or legal matter; or when disclosure is required or permitted by law.
Our service providers may use mobile information and SMS-related data only as necessary to provide services to Cage & Miles and are restricted from using that information for their own independent marketing or promotional purposes.

9. Supported Carriers and Message Delivery
SMS services are available through participating wireless carriers. Wireless carriers are not liable for delayed or undelivered messages.
Delivery is subject to operation and availability of wireless networks, the accuracy of the telephone number you provide, device settings, carrier filtering, and other factors outside Cage & Miles’ control.
Cage & Miles does not guarantee that any text message will be received, delivered, or reviewed within a particular time.
10. Confidentiality, Security, and Time-Sensitive Communications
Text messaging may not be secure or confidential. Messages may be viewed by anyone with access to your mobile device, telephone account, cloud backups, linked devices, or connected applications.
Exercise particular caution if another person (including a spouse, former spouse, partner, family member, household member, or opposing party) may have access to your device, account, password, or message notifications.
Do not send highly sensitive, confidential, privileged, financial, medical, or personal information by text message unless your attorney or an authorized Cage & Miles representative has specifically instructed you to use that method.
Do not use text messaging:
- In an emergency or potentially dangerous situation;
- To report an immediate threat or request emergency assistance;
- To communicate court deadlines, filing instructions, settlement acceptances, or other time-sensitive legal instructions;
- To provide formal legal notice or serve legal documents;
- To transmit information that requires immediate action;
- To assume that Cage & Miles has received or reviewed a message; or
- When immediate confirmation is required.
Text messages are not continuously monitored.
If you are experiencing an emergency or immediate threat, call 911 or the appropriate emergency service. For urgent legal communications, contact your attorney or Cage & Miles directly by telephone using the contact information provided to you.
Cage & Miles may limit the substantive information included in text messages to protect your privacy and confidentiality.
11. No Attorney-Client Relationship or Legal Advice via Text
Text messages are provided for convenience and administrative communication.
Sending a text message to Cage & Miles, receiving a response, submitting an intake form, or participating in an initial consultation does not, by itself, create an attorney-client relationship.
An attorney-client relationship is established only through an applicable written engagement agreement or another express agreement by Cage & Miles to provide legal representation.
Text messages are not a substitute for individualized legal advice and should not be relied upon as confirmation that Cage & Miles has received, reviewed, accepted, or acted upon a communication unless the firm expressly confirms otherwise.
Nothing in these SMS Terms expands the scope of any legal representation agreed to in an engagement agreement.
12. Changes to or Termination of the SMS Program
Cage & Miles may modify, suspend, or discontinue all or part of its SMS messaging program at any time.
We may update these SMS Terms periodically by posting a revised version on our website and updating the “Last Updated” date.
Cage & Miles may revise its SMS practices and these SMS Terms as reasonably necessary to address changes in applicable law, regulatory guidance, industry standards, messaging technology, or the services offered through the SMS program.
Any revised practices will apply prospectively. When required by applicable law, Cage & Miles will provide additional notice or obtain renewed or supplemental consent before applying a material change to your SMS communications.
An update to these SMS Terms will not retroactively expand the scope of consent you previously provided.
