However, because these cases often involve complex financial structures and significant assets, having an experienced high-net-worth divorce attorney is essential to protect your interests and ensure any settlement is both equitable and enforceable.

High-net-worth families often own complex assets that require specialized valuation and division—privately held business interests, commercial real estate, or restricted stock options and deferred compensation. The process involves three key steps:

  1. Conduct a detailed asset review with your attorney to identify what needs valuation and whether you'll need independent valuation experts. This often includes separate property assets you might not expect to have to value.
  2. Determine your preferred division strategy, i.e., which assets are best for your future. Even assets with identical fair market values can have very different benefits for you—keeping one over another could significantly impact your financial future.
  3. Effectuate your division strategy. This is especially challenging with non-transferrable business interests or lopsided portfolios that are logistically difficult to split, requiring creative and customized solutions.

High-net-worth families often have sources of non-wage income such as trust payments, rental properties, K-1 distributions, or business expense accounts. The key question: do these count as income for child support and spousal support calculations?

This determination includes a lot of discretion and depends on factors like frequency and reliability. If a trust or business pays your living expenses, car costs, meals, or provides a credit card, those benefits might be treated as income. How you frame and argue these monetary benefits can determine whether the court considers them income available for support.

For W-2 wage earners, tax returns are presumptively correct as income. For earners with other sources of income, tax returns are just the start of the analysis. Certain items like tax deductible expenses or depreciation might be added back to income for support purposes. Be prepared to explain your income and expenses in detail.

A related concept is marital standard of living (MSOL), which establishes what the court views as reasonable needs.
